Terms of Service: Treasure Life's Journey

1. Agreement to these Terms

Welcome to Treasure Life's Journey. This website, https://www.treasurelifesjourney.com (the "Site"), is run by Treasure Life's Journey LLC, the business of Jackie Wu, a coach, mentor and speaker based in the San Francisco Bay Area ("we", "us"). These Terms of Service ("Terms") are an agreement between you and us about your use of the Site only.

By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old, or the age of majority where you live, to agree to these Terms. If you use the Site for a company or organization, you confirm that you can agree on its behalf, and "you" includes that organization.

The Site is simple: it has public pages about Jackie's speaking and coaching, client stories and resources, and forms that let you contact us, book a free discovery call or enroll. These Terms cover the Site only. They do not cover our speaking or coaching services, which are governed by their own written agreements. If one of those agreements and these Terms ever conflict, the signed agreement wins for the services it covers.

2. Using the Site

You may use the Site for your own personal or business purposes, to learn about our services and to get in touch. In return, you agree to use it lawfully and respectfully.

When you send us a message, book a discovery call or enroll through a form, you agree to give accurate, current information and to keep it up to date. Please do not include sensitive details, such as health, financial account or government ID numbers, in a message. We may decline or cancel a booking if the information is inaccurate or the request is abusive. Sending a form or booking a call does not create a coaching or speaking agreement and does not reserve a place in a program.

You agree not to:

use the Site in a way that breaks any law or infringes anyone's rights;
copy, scrape, frame or republish the Site or its content, except as these Terms allow;
send spam, malware or anything harmful through our forms;
try to gain unauthorized access to the Site, its servers or the data behind it, or interfere with how it works;
use the Site to harass, impersonate or defame anyone, including the clients and speakers featured in testimonials;
use automated tools to access the Site, other than search engines indexing it in the normal way.

We may suspend or block access to the Site for anyone who breaks these rules, without notice.

3. Our content and your submissions

The Site and its content, including text, photos, videos, graphics, the logo, the one-sheet and other downloadable resources, belong to us or to the people who licensed them to us, and are protected by copyright and trademark law. "Treasure Life's Journey", "FAQ Formula" and "One Conversation to YES" are our marks. You may not use them without our written permission.

You may view, download and print pages and resources from the Site for your own use, and meeting planners may use the Meeting Planner Resources to promote an event Jackie is speaking at, as long as you keep all copyright notices and do not change the materials. Any other use, including commercial reproduction or posting our videos elsewhere, needs our written permission. Links to the Site are welcome.

If you send us feedback, a testimonial, a story about your results or other material ("Submissions"), you give us a worldwide, royalty-free license to use, edit for length and clarity, publish and display it on the Site and in our marketing, with your name, title, photo or video as you provide them, for as long as we use it. You confirm that your Submission is yours to give and does not infringe anyone else's rights. You can ask us to stop using a testimonial at any time by contacting us. We will remove it from the Site within 30 days and will not use it in new materials; copies already printed or distributed may remain.

If you believe content on the Site infringes your copyright, email info@treasurelifesjourney.com with the details and we will respond promptly.

4. Other companies' services, privacy and cookies

The Site links to and embeds services from other companies, such as YouTube videos, Google Analytics and our hosting and database providers. We do not control those services, and their own terms and privacy policies apply when you use them. A link from the Site is not an endorsement.

How we handle your personal information, including the forms, analytics and cookies, is explained in our Privacy Policy, which is part of these Terms. The Site uses analytics cookies unless you choose "No thanks." in the cookie notice. You can change that choice at any time with the "" link in the footer.

We may change, pause or remove any part of the Site at any time, and we may not always be able to keep it available or free of errors.

5. Disclaimer and limits on our liability

The Site and its content are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Site will be uninterrupted, secure or error-free.

To the fullest extent the law allows, we and our owners, employees and contractors will not be liable to you for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Site or its content, even if we were told such damages were possible. Our total liability to you for all claims relating to the Site will not exceed one hundred US dollars ($100).

Some states do not allow some of these limits, so some may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

You agree to defend and indemnify us against claims, losses and reasonable legal costs that arise from your Submissions, your breach of these Terms, or your misuse of the Site.

6. Disputes and governing law

Talk to us first. If you have a dispute with us about the Site or these Terms, email info@treasurelifesjourney.com with your name, contact details and a description of the problem. We will do the same if we have a dispute with you. We will each try in good faith to resolve it informally for 30 days before either of us starts a legal proceeding.

Where disputes are heard. If we cannot resolve a dispute informally, it will be decided by the state or federal courts located in Santa Clara County, California, and you and we consent to the jurisdiction of those courts. Either of us may instead bring a claim that qualifies in small claims court. Each of us agrees to bring claims only in our own name, not as part of a class or representative action, to the extent the law allows.

Governing law. These Terms and any dispute are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules. If you live outside the United States, you may also have rights under the mandatory consumer laws of your country that this section does not take away.

7. General terms

Changes. We may update these Terms from time to time. We will post the new version here and update the date at the top. Changes apply from the date they are posted; if you keep using the Site after that, you accept them. The dispute section in force when a dispute started will continue to apply to that dispute.

Ending access. You can stop using the Site at any time. We may suspend or end your access if you break these Terms. Sections 3, 5, 6 and 7 continue to apply after that.

Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Site. They do not replace or change a signed coaching or speaking agreement. If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a term right away, we can still enforce it later. You may not transfer your rights under these Terms; we may transfer ours to a successor of the business.
